TERMS AND CONDITIONS OF THALYS INSIDE PANEL

1. Foreword

1.1. Company

THI FACTORY, a limited liability company incorporated under Belgian law, with headquarters located at Place Marcel Broodthaers 4 in 1060 Brussels, Belgium, registered with the Crossroads Bank of Enterprises under the VAT number BE 0541.696.005, (hereinafter referred to as "Thalys") has created and manages a panel called THALYS inside (hereinafter referred to as the "Panel"). The purpose of these Terms and Conditions is to lay down the operating procedures of the Panel. Any person who has registered for the Panel (hereinafter "Member") is deemed to have read and accepted these Terms and Conditions without reservation.

1.2. Acceptance of the Terms and Conditions

These Terms and Conditions take effect upon their validation by the Member during registration.

2. Purpose

The purpose of the Panel is to collect Members' comments and suggestions about Thalys, as well as about their journeys in general, through online surveys that are regularly launched to help improve the Thalys offer. Contributing to the Panel allows Members to accumulate inside points:

  • that can be exchanged for a selection of gifts in the THALYS inside gift shop by any non-members of the My Thalys World customer relationship programme (see below article 4.3);
  • in the form of Miles for members of the My Thalys World programme, that can be used in accordance with the terms and conditions of the My Thalys World programme.

3. Registration

3.1. Conditions of Registration

Membership is free of charge and open to any physical person aged 18 (on the day of registration) with a valid email address who has travelled at least once with Thalys, and who has validated these General Terms and Conditions and familiarised him or herself with the Thalys Inside Privacy Policy. Legal entities cannot join the Panel.

In case of any contradiction between these Terms and Conditions and those of the My Thalys World Programme, the Terms and Conditions of the My Thalys World Programme shall prevail for the Member for the duration of membership of the Panel.

3.2. Registration procedure

Any person who wishes to register for the Panel must complete the Panel registration form on the website www.thalysinside.com. Only one request to join per person will be considered. The applicant guarantees the accuracy of all information provided on the registration form and will be solely responsible for any erroneous, incomplete or obsolete information. Any incorrect, incomplete or obsolete application for registration may be considered invalid; an application containing false information may be subject to criminal prosecution. The applicant authorises all the legal checks concerning his or her identity and telephone, postal and electronic contact details. Further to this request, an email confirming registration is sent to the Member. To activate a THALYS inside account, the Member simply clicks on the link that appears in the confirmation email and completes a questionnaire that allows Thalys to get to know the Member's profile better.

3.3. Cancellation by the Member

Members can cancel membership of the Panel at any time, by using the link available on the website www.thalysinside.com. In the event of the death of the Member, Panel membership will automatically terminate. This termination can under no circumstances give rise to any compensation or indemnity and all the inside points accumulated to date will be cancelled, including in the event of a new registration at a later time. With regard to Miles, the terms and conditions of the My Thalys World programme prevail.

3.4. Exclusion by Thalys

Thalys reserves the right to exclude from the Panel any Member who does not comply with these Terms and Conditions, or who has misused or fraudulently used his or her membership of the Panel or inside points.

The excluded Member may be excluded for any subsequent application. The exclusion will not give rise to any compensation or indemnity, and all inside points accumulated to date will be cancelled. With regard to Miles, the terms and conditions of the My Thalys World programme prevail.

4. Inside points

4.1. Acquisition of inside points

Non-members of the My Thalys World programme will be directly attributed 100 inside points per questionnaire, credited to their THALYS inside account, where the Member can consult them.

Members of the My Thalys World programme will be directly attributed 100 Miles per questionnaire, credited to their My Thalys World account. 

4.2. Validity of inside points

The inside points accumulated by non-members of the My Thalys World programme remain valid throughout the duration of the membership of the Member.

The validity of Miles accumulated by the members of the My Thalys World programme is defined in the terms and conditions of the My Thalys World programme.

It is not possible to transfer, bequeath, assign or sell inside points or Miles to a third party.

4.3. Using inside points

4.3.1 The THALYS inside Shop - Gift catalogue

As soon as the Member has accumulated enough inside points, he or she can visit the website www.thalysinside.com to exchange these inside points for a selection of gifts presented there.

Following the validation of an order, a confirmation is sent to the Member by email. Confirmation of the order constitutes confirmation of receipt and not acceptance of the order, which however, can no longer be changed by the Member. Once the order has been placed, the inside points will be automatically deducted from the Member's account. A confirmation email will be sent to the Member when the order is validated.

Orders are processed each month and the delivery of the gift will take place during working days. Delivery is made approximately 1 to 5 weeks after acceptance of the order. The delivery of the gift will be made to the email address used to register for the Panel, as the selection of gifts is in the form of electronic vouchers.

Gifts that have been ordered cannot be exchanged or returned. If the promotional code on the voucher is defective, the Member should contact Support.Thalysinside@thalys.com, who – after verification – will reach out to the manufacturer and will send another voucher if required.

As product quality is constantly improving, certain products may differ from the illustrations. If the visual representation of a product contains decorative elements, they are not part of the order. Thalys cannot accept responsibility for typographic errors on the website www.thalysinside.com if they are not the intention of the   THALYS inside Shop.

4.3.2 Using Miles

Miles are used in accordance with the terms and conditions of the My Thalys World programme.

5. Additional advantages

Panel Members can also take part in contests (for example: idea challenges, photo essays, etc.) to win prizes (for example: museum tickets, vouchers for car rental services, etc.) with partners of Thalys. Contest rules for each contest will specify the conditions for participation.

Thalys reserves the right to invite its Members to private customer events.

6. General rules

6.1. Changes to and Termination of the Panel

Thalys reserves the right to change or modify the Panel at any time, without notice, as well as these General Terms and Conditions. In the event of refusal of these modifications, the Member is free to terminate his or her membership under the conditions set out in article 3.3.

Thalys is entitled to terminate the Panel at any time, observing a 3-month notice period. In the event that the Panel is cancelled, unused inside points will be cancelled without compensation.

Thalys cannot be held responsible for losses, costs or any other damages or prejudice that directly or indirectly result from changes to or the termination of the Panel.

6.2 Processing of personal data

The personal data provided by the Member when registering for the Panel will be used, processed and stored by Thalys, in accordance with the Thalys Inside Privacy Policy as presented to the Member upon registration. To this end, Thalys, as controller, will fulfil all of its obligations under the GDPR with regard to the protection of Personal Data.

Thalys thereby undertakes to preserve the integrity and confidentiality of the Personal Data and to put in place the technical and organisational measures necessary to protect said Data in accordance with the applicable legislation.

Thalys will take the technical and organisational measures required to protect the Personal Data against accidental or unauthorised destruction, against accidental loss as well as against modification, access and any other unauthorised processing of Personal Data. These measures must ensure an adequate level of protection, taking into account, on the one hand, the state of the art in this field and the costs entailed by the application of these measures and, on the other hand, the nature of the data to be protected and potential risks.

The Personal Data provided by the Member hereunder are and will remain the exclusive property of the Member.

The Member has a right of access, rectification, portability and the erasure of his personal data, as well as a right to object and limit their processing. These rights may be exercised in accordance with the Thalys Inside Privacy Policy, as presented to the Member during registration.

6.3 Intellectual Property

Thalys owns all the intellectual property rights, artistic or otherwise, used in the Panel. Registration and use of the Panel does not confer or transfer to the Member any rights to these intellectual property rights.

In accordance with the laws in force governing intellectual property rights, the reproduction and the representation, without prior written authorisation from Thalys, of all or part of the elements communicated or of which the Member can take cognisance during the participation on the Panel are strictly prohibited.

6.4. Responsibilities

Unless otherwise required by law, Thalys cannot be held responsible in the event that emails, including those containing vouchers, are sent to an incorrect address, for problems with telephone and Internet connections that delay or prevent fulfilment of the obligations incumbent upon it in the framework of the Panel. In this context, Thalys cannot be held responsible for any problem of accessibility and/or unavailability of the website www.thalys.com and related services and advantages.

The liability of Thalys is limited to re-crediting inside points to the Member account in the event of a technical incident.

Thalys cannot be held responsible in the event that advantages offered by its partners are not available.

With regard to Miles, the terms and conditions of the My Thalys World programme prevail.

6.5. Validity of the clauses

In the event that one or more clauses of these General Terms and Conditions would be held to be invalid, unlawful or cannot be implemented, all other clauses shall remain valid and applicable.

6.6. Competent court and Applicable law

The Thalys Inside Panel and these General Terms and Conditions are governed by Belgian law and any dispute relating to the application or interpretation of these conditions shall fall under the exclusive jurisdiction of the courts of Brussels.

6.7. Language Versions

These General Terms and Conditions are available in French, Dutch, English and German versions. In the event that there would be any discrepancy between these different versions, the French version shall prevail.
